AI And Compliance: What To Know

Key points: Artificial Intelligence (AI) is a serious game-changer in healthcare. Compliance and risk management are more crucial than ever. The foundation of compliance is an organized plan with clear steps.

Things are always changing in the healthcare landscape, and they are changing fast. Artificial Intelligence (AI) is not just a new trend anymore; it is a serious game-changer for navigating complex regulatory requirements.

“Healthcare compliance is the formal name given to proactive tasks to prevent fraud, waste, or abuse within a healthcare entity. A compliance program is the active, ongoing process to ensure that legal, ethical, and professional standards are met and communicated throughout the entire healthcare organization. The foundation of compliance culture is an organized plan with steps often referred to as compliance elements.”

Compliance and risk management are more crucial than ever. AI-driven platforms will likely change the way healthcare organizations proactively identify, mitigate, and monitor compliance risks.

In December 2024 “The Department of Health and Human Services (HHS) and the Office for Civil Rights (OCR) have announced they will be soliciting comments on a proposal to modify the Security Standards for the Protection of Electronic Protected Health Information (ePHI)under the Health Insurance Portability and Accountability Act (HIPAA) of 1996 and the Health Information Technology for Economic and Clinical Health Act of 2009.”
The modifications, published in the Federal Register on January 6, 2025, address “significant changes in technology, breach trends, enforcement, best practices and methodologies for protecting ePHI and take into account court decisions that affect Security Rule enforcement.”

Staying compliant demonstrates a commitment to responsible AI use. Compliance with regulations such as HIPAA safeguards patient information and ensures legal adherence. But staying compliant with changing regulations can be challenging and non-compliance can result in penalties and loss of reputation for your organization.
